Les règles relatives à l'animal sont dispersées dans des lois spéciales et des codes, notamment le Code pénal et le Code rural. Au fil des années, c'est un foisonnement de règles spécifiques qui se sont additionnées, favorisant la protection de l'animal mais empêchant une perception globale. Les règles protectrices varient d'un animal à l'autre, ce qu'illustre la traditionnelle opposition entre l'animal de compagnie et l'animal sauvage. Au-delà de cette opposition, c'est ainsi une multiplication de catégories d'animaux que le droit semble avoir constitué à travers l'allocation d'une protection plus ou moins efficiente. Dès lors, la réflexion sur le statut de l'animal s'emplit de cette difficulté, interrogeant sur la réalité de ce statut et de l'éventuel pluriel. L'étonnement est à son comble pour les animaux appartenant à différentes catégories, à l'image du chien qui peut être de compagnie, sauvage, dangereux, de laboratoire ou employé dans le travail de l'homme. Pourtant, une protection de l'animal comme "être doué de sensibilité" peut-elle encore se concilier avec une approche catégorielle ? Doit-on et peut-on dépasser cette approche ? Les différentes contributions de cet ouvrage permettent de se saisir de cette question en appréhendant les principales catégories d'animaux pour la construction d'une protection adaptée. En envisageant les spécificités de ces catégories, il s'agit de réfléchir aux apports pour la création d'un statut juridique adapté pour les animaux. Actes enrichis du colloque organisé le 7 novembre 2019 à la Faculté de droit de l'Université de Brest.

"In Animals as Legal Beings, Maneesha Deckha critically examines how Canadian law and, by extension, other legal orders around the world, participate in the social construction of the human-animal divide and the abject rendering of animals as property. Through a rigorous but cogent analysis, Deckha calls for replacing the exploitative property classification for animals with a new transformative legal status or subjectivity called "beingness." In developing a new legal subjectivity for animals, one oriented toward respecting animals for who they are rather than their proximity to idealized versions of humanness, Animals as Legal Beings seeks to bring critical animal theorizations and animal law closer together. Throughout, Deckha draws upon the feminist animal care tradition, as well as feminist theories of embodiment and relationality, postcolonial theory, and critical animal studies. Her argument is critical of the liberal legal view of animals and directed at a legal subjectivity for animals attentive to their embodied vulnerability, and desirous of an animal-friendly cultural shift in the core foundations of anthropocentric legal systems. Theoretically informed yet accessibly presented, Animals as Legal Beings makes a significant contribution to an array of interdisciplinary debates and is an innovative and astute argument for a meaningful more-than-human turn in law and policy."--
